Under Senate Bill 464, any private employer with 100+ employees and at least 1 employee in California is required to submit a pay data report to the state each year. It is due on or before the second Wednesday in May, and the requirement applies even to employers who don’t have to submit an EEO-1 report. It also applies to those hiring employees through labor contractors, and the report must include the names of those contractors.
On January 1, 2026, the requirement goes into effect that any information gathered by a labor contractor or employer for pay data reporting must be kept separately from employee personnel records. The following year, January 1, 2027, an increase to the job categories required for reporting will occur. This list will include the following occupations:

- Management
- Production
- Business/financial
- Installation/maintenance/repair
- Computer/mathematical
- Construction/extraction
- Architecture/engineering
- Farming/forestry/fishing
- Life/social/physical science
- Office/admin support
- Community and social science
- Sales
- Legal
- Personal care and service
- Educational instruction
- Library
- Building/ground cleaning/maintenance
- Art/design/entertainment/media/sports
- Healthcare practitioners, technical, and support
- Food prep and serving
