Senate Bill 294 requires employers to provide a new annual notice, starting on or before February 1, 2026. This written, standalone notice must be given to each current employee via email, text message, or personal service, and should be reasonably anticipated to be received within a business day of sending.
The notice must contain the following details about workers’ rights:
- The right to workers’ compensation benefits, including medical care and disability pay, for work-related illnesses and injuries
- The contact information for the California Division of Workers’ Compensation
- Constitutional rights when interacting with law enforcement in the workplace
- The right to notice of inspection by immigration agencies (under state law)
- The right to engage in concerted activity or organize a union
- Protection against immigration-related practices against an individual exercising their rights
A description of new legal developments and enforcement agencies that may enforce the rights should also be included. It should be provided in the language normally used by the employer to communicate information to the employee.
