Virginia enacted House Bill 1, which established the state minimum wage and annual increases. As of January 1, 2026, the minimum hourly rate of pay is $12.77 per hour. January 1, 2027 will see an increase to $13.75, followed by an increase to $15.00 per hour on January 1, 2028. The law states that the minimum wage following that increase will be established by October 1 and adjusted each year, although the change cannot be negative.
Farm laborers and farm employees were previously excluded from the definition of employees who were required to earn the minimum state hourly wage. Under House Bill 20, these workers will now be included and must receive the minimum hourly rate of pay.
