A third delay has been enacted in Maryland for the program providing wage-replacement and job protection benefits to employees taking time off work for certain medical and family reasons. House Bill 102 enacts the delay and clarifies other aspects of the legislation. Covered employees and employers will begin making contributions on January 1, 2027, and employees will be entitled to receive benefits by January 3, 2028. The precise date will be determined by the Maryland DOL.
Additional definitions and clarifications are also included in the bill. It defines anchor date (the earlier of the date on which a benefits-eligible leave begins or the application is complete) and application year (the 12-month period when leave begins, beginning the Sunday of the calendar week). It also amends the definition of a covered employee to include performing services under employment in the state over the past four most recent quarters.
