New legislation in Minnesota will expand the rest and meal break period requirements. The change will go into effect January 1, 2026.
Currently, the law requires employers to provide time to employees within every four hours of work to use a restroom. The change requires the provision of a paid rest break lasting at least 15 minutes to do so. The language around meal breaks will shift from “permit” to “allow” employees to take a break lasting at least 30 minutes to eat a meal when working for 6+ consecutive hours.
