Due to the length and complexities of the Family and Medical Leave Act, employers can easily fall victim to common pitfalls. In no particular order, here are the top 10 most common FMLA mistakes employers make.
An employee’s spouse has died suddenly. Her supervisor calls her several days later to express condolences. She is crying uncontrollably and barely coherent. She tells him she cannot sleep, has difficulty functioning, and will need 30 days of leave to take care of things. The supervisor tells her okay, and he will notify HR.
Assuming she is eligible, is this sufficient notice to trigger FMLA obligations?
