The Oregon Court of Appeals ruled that employees are protected from retaliation in response to asking for a raise, even if no claim of class-based discrimination or pay inequity is alleged. The appeal came in response to a worker within the state requesting an additional increase in pay after receiving a pay raise and promotion. Following the inquiry, the employee was terminated from employment.
Under ORS 659A.355(1)(a), employees maintain protection from adverse action or retaliation simply for inquiring about, disclosing, or discussing wages. The court determined that the language of the law applies to employees inquiring about their own wages when asking for increases.
