Colorado enacted new legislation, effective July 3, 2026, that prohibits employers or employer agents from confiscating, demanding, or retaining a government-issued ID card from individuals performing or seeking work. The following exceptions apply:
- Requesting and temporarily retaining to verify employment eligibility
- Retaining ID documents in employee records
- Retaining the card as long as necessary (cannot exceed 10 hours)
Employers must also provide notice when requesting a government-issued ID for one of the permitted purposes outlined above. The notice must be given in writing, written in English (and the employee’s primary language, if it is not English), acknowledged, and retained in employment records.
